Please read these terms and conditions carefully before using YogenApp. By accessing or using the service, you agree to be bound by these terms. If you do not agree with any part, you may not use the service.

2. Definitions
For the purposes of these terms and conditions:
- "Platform": The set of services and features offered by YogenApp.
- "User": Any person who accesses or uses the Platform.
- "Center": The entity (yoga center, studio, or professional) that contracts YogenApp services.
- "Administrator": User with full management permissions for the Center.
- "Teacher": User with permissions to manage classes and attendance.
- "Student": End user who participates in the Center's classes.
- "Subscription": The plan contracted by the Center to use YogenApp.
- "Account": A User's unique registration on the Platform.
3. Service Description
YogenApp is a comprehensive management platform for yoga centers that offers the following features:
3.1 Class and Event Management
- Creation and management of regular classes with recurring schedules
- Organization of one-time events and workshops
- Assignment of teachers and rooms
- Capacity and occupancy control
- Yoga sequence management with visual editor
3.2 Student Management
- Student registration and profiles
- Attendance tracking
- Absence and make-up class management
- Tag system for classification
- Customizable fields
3.3 Subscriptions and Plans
- Creation of customized subscription plans
- Weekly class limits
- Pause and cancellation management
- Discount application
3.4 Invoicing
- Automatic invoice generation
- SEPA XML file generation for direct debits
- Credit notes
3.5 VeriFactu (Spanish Tax Agency Integration)
- Automatic invoice submission to the Tax Agency
- Digital invoice signing
- Digital certificate management
- QR code verification generation
3.6 Communications
- Email notification sending
- Customizable templates
- Automatic payment reminders
- Registration confirmations
4. Registration and User Account
4.1 Registration Requirements
To use YogenApp, you must create an account by providing accurate, complete, and up-to-date information. Requirements include:
- Being of legal age
- Providing a valid email address
- Verifying the account through the link sent by email
- Accepting these terms and conditions
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Immediately notifying any unauthorized use
- Not sharing access credentials with third parties
4.3 User Types
The Platform includes three types of users with different access levels:
- Administrators: Full access to all management features
- Teachers: Access to class management, attendance, and assigned features
- Students: Access to their profile, enrollments, payments, and history
5. User Obligations
5.1 Acceptable Use
The User agrees to:
- Use the service only for lawful and legitimate purposes
- Not introduce viruses, malware, or malicious code
- Not attempt to access other users' accounts
- Not overload or interfere with the Platform's operation
- Respect intellectual property rights
- Keep personal data up to date
5.2 Data Responsibility
Centers using YogenApp are responsible for:
- Obtaining consent from their students for data processing
- Ensuring the accuracy of entered data
- Complying with applicable data protection regulations
- Informing their students about the use of the Platform
6. YogenApp Subscription
This section governs the Center's subscription to the YogenApp platform.
6.1 Plans and Pricing
YogenApp offers different subscription plans with specific features and limits. Prices are shown on the pricing page and do not include applicable VAT according to current legislation.
6.2 Subscription Billing
- YogenApp subscriptions are billed in advance according to the contracted period
- Invoices are automatically generated and sent by email
- The amount will include the corresponding VAT
- Invoices comply with current tax regulations
6.3 Renewal and Cancellation
- Subscriptions renew automatically at the end of each period
- You can cancel your subscription at any time from your account
- Cancellation will be effective at the end of the billed period
- No prorated refunds are made for early cancellations
6.4 Non-Payment
In case of subscription non-payment:
- A reminder will be sent by email
- After 15 days, access to the service may be suspended
- After 30 days, the account may be permanently canceled
- Data will be retained according to applicable regulations
7. Student Payment Management
YogenApp provides tools for managing payments that students make to the Center. These payments are managed externally to the platform.
7.1 Configurable Payment Methods
The platform allows configuring and recording different payment methods for students:
- SEPA Direct Debit: Generation of SEPA XML files for external processing
- Credit/Debit Card: Recording of card payments
- Other methods: According to Center configuration
The actual collection of payments is done outside YogenApp, through the banking or payment channels that the Center has contracted.
7.2 Wallet System
YogenApp offers a virtual wallet system for students that allows:
- Recording balance in the student's account
- Deducting classes and services from available balance
- Managing promotional credits
7.3 Center Responsibility
The Center is solely responsible for:
- The management and effective collection of payments from their students
- The contractual relationship with banking entities or payment processors
- Compliance with applicable payment regulations
- The accuracy of student banking data entered in the platform
8. VeriFactu and Electronic Invoicing
8.1 VeriFactu Service Description
YogenApp offers integration with the Spanish Tax Agency's (AEAT) VeriFactu system for automatic invoice submission. This service includes:
- Digital invoice signing with electronic certificate
- Automatic submission to AEAT
- QR code verification generation
- Credit note management
8.2 Digital Certificate
To use VeriFactu, the User must:
- Have a valid digital certificate issued by a recognized certification authority
- Upload the certificate to the Platform securely
- Accept the specific terms of certificate use
- Be responsible for the custody and renewal of the certificate
8.3 VeriFactu Responsibilities
The User is solely responsible for:
- The accuracy of billing data
- Compliance with tax obligations
- The validity of the digital certificate
- Reviewing invoices before submission
YogenApp acts only as a technological intermediary and assumes no responsibility for errors in data entered by the User.
9. Intellectual Property
9.1 YogenApp Rights
All intellectual property rights over the Platform, including but not limited to:
- Source code and software
- Design, interface, and user experience
- Trademarks, logos, and distinctive signs
- Texts, images, and content
- Databases and structures
are the exclusive property of Pau Giralt Monedero or its licensors. Use of the Platform does not confer any rights over these elements.
9.2 License of Use
YogenApp grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Platform in accordance with these terms. This license does not permit:
- Copying, modifying, or creating derivative works
- Reverse engineering or decompiling the software
- Sublicensing, selling, or transferring access
- Using the YogenApp brand without authorization
9.3 User Content
The User retains all rights to the content they enter into the Platform. By using YogenApp, the User grants a limited license to process and store this content for the purpose of providing the service.
10. Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy and applicable regulations:
- General Data Protection Regulation (GDPR)
- Spanish Organic Law 3/2018 on Data Protection (LOPDGDD)
Centers using YogenApp act as data controllers for their students' data, and YogenApp acts as data processor.
11. Limitation of Liability
11.1 Service Availability
YogenApp strives to maintain continuous service availability. However, the following is not guaranteed:
- Uninterrupted service availability
- Absence of errors or defects
- Compatibility with all devices or browsers
11.2 Exclusions
YogenApp shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages arising from incorrect use of the Platform
- Errors in data entered by the User
- Problems with third-party services (banks, AEAT, email providers)
- Interruptions due to scheduled maintenance or emergencies
11.3 Maximum Limit
In any case, YogenApp's maximum liability is limited to the total amount paid by the User during the 12 months prior to the incident.
12. Modifications
12.1 Service Modifications
YogenApp reserves the right to:
- Modify, update, or improve features
- Add or remove characteristics
- Suspend or interrupt the service with prior notice
12.2 Terms Modifications
We reserve the right to modify these terms at any time. Modifications:
- Will be published on this page with the new update date
- Will be sent by email in case of substantial changes
- Will be effective 30 days after notification
Continued use of the service after modifications implies acceptance of the new terms.
13. Suspension and Termination
13.1 Suspension by YogenApp
YogenApp may suspend or cancel access in case of:
- Breach of these terms
- Non-payment of fees
- Fraudulent or illegal use of the service
- Request from competent authorities
13.2 Cancellation by User
The User may cancel their account at any time. After cancellation:
- Access will be maintained until the end of the billed period
- Data will be retained according to legal deadlines
- Deletion of personal data may be requested
- Issued invoices will remain accessible for legal compliance
13.3 Effects of Termination
After termination:
- Access to the Platform will be revoked
- The User may request data export for 30 days
- Confidentiality and intellectual property obligations will remain in effect
14. Applicable Law and Jurisdiction
These terms and conditions are governed by Spanish law. For any dispute arising from the interpretation or execution of these terms, the parties submit to the courts and tribunals of Barcelona, Spain, with express waiver of any other jurisdiction that may apply.
15. General Provisions
15.1 Entirety
These terms constitute the complete agreement between the parties and supersede any prior agreement.
15.2 Severability
If any clause is declared void, the remaining clauses will continue in effect.
15.3 Waiver
Failure to exercise a right does not constitute waiver of that right.
15.4 Assignment
The User may not assign their rights or obligations without prior consent. YogenApp may assign the contract to any group company or in case of merger or acquisition.
